Overview
Please read these Terms and Conditions carefully before accepting them and print out a copy for your records, along with all confirmation emails, specific terms, transaction data, rules and payment methods relevant to your use of the services made available at www.telegraph.co.uk/fantasyfootball and the mobile application.
These Terms and Conditions are effective from July 28, 2025.
Telegraph Fantasy Games Rules
The “Telegraph Fantasy Games Rules” incorporate Telegraph Media Group’s (TMG) Gambling Policy and govern your participation in any Telegraph Fantasy Games. By playing Telegraph Fantasy Games, you agree to be bound by the Telegraph Fantasy Games Rules.
By registering to play the 2025/2026 edition of Telegraph Fantasy Football, you agree to receive a weekly newsletter (by email) containing the latest game news, fantasy football selection tips, reminders of key dates etc. You can unsubscribe from this newsletter at any time during the season.
1. Definitions for Telegraph Fantasy Football Competition
1.1 The following definitions apply in relation to the Telegraph Fantasy Football Game 2025/2026 (“TFF”) only:
- “Application(s)” means the application to enter a team selection in the Competition;
- “Assist” (in relation to scoring points) means one of your selected players has made a significant contribution to a goal scored by his football club and is determined by the awarding of an assist by Opta;
- “Chairman” means any chairman of a Private League;
- “Genius Sports” means Genius Sports the provider of the Competition, whose registered company number is 9975401 and address is 10 Bloomsbury Way, London, WC1A 2SL, UK;
- “Competition” means the TFF competition taking place during the 2025/2026 domestic English football season, which is currently scheduled to run from Friday, August 15, 2025 until Sunday, May 24, 2026;
- “Event” means an eligible Premier League, FA Cup or League Cup match;
- “Game Week” means each 00:00 Tuesday to 23:59 Monday period during the Competition when TFF points are scored.
- “Manager” means the individual responsible for the account registration, selection and entry of an individual team to the Competition;
- “Private Leagues” means any league that is set up by a Manager;
- “Scheduled Event Kick-off” means the stated published time at which an eligible match (or group of eligible matches) is due to start (in the case of delays, the original scheduled kick-off stands);
- “Starting XI” means a Manager’s registered team of eleven players as they stand at 20.00 (BST) on Friday, August 15, 2025;
- “Super 16s” are public head-to-head leagues comprising sixteen teams each;
- “TFF” means Telegraph Fantasy Football 2025/2026;
- “TMG” means Telegraph Media Group Holdings Limited, the promoter of the Competition, whose VAT number is 472967739, registered company number is 14551860 and address is 111 Buckingham Palace Road, London, SW1W 0DT;
- “Tournament” means any public league or knock-out cup competition;
- “Website” means www.telegraph.co.uk/fantasyfootball and any related sub-domains.
2. Eligibility
2.1 “How to enter” and any other instructions detailed in advertisements for the Competition on the Website or in any other TMG publication shall form part of the Terms and Conditions of this Competition.
2.2 By entering this Competition you agree to be legally bound by such Terms and Conditions.
2.3 Genius Sports and TMG employees, or those employed by Genius Sports' and TMG's subsidiaries and anyone else connected with the Competition may enter but shall not be eligible to claim any of the main league prizes or take an active part in a Private League which is eligible to win any of the prizes.
2.4 Entry to this Competition is valid to everyone but prizes are restricted to players aged 18 and over who are residents of the United Kingdom, Republic of Ireland, the Channel Islands, and the Isle of Man.
3. How to enter
3.1 Each user may submit up to five free teams into the Competition, provided that each entry adheres to these Terms and Conditions.
3.2 Managers must not register teams in other names or with multiple email addresses in an attempt to unfairly increase their chances of winning prizes. Managers found to be controlling more than five teams under more than one name in the Competition may have all teams under their control removed from the Competition and/or may not be eligible to win any prizes.
3.3 TMG reserves the right to disqualify players and/or their teams which in TMG's sole opinion do not comply with these Terms and Conditions or which contravenes the spirit of the Competition. The decision will be final and no correspondence will be entered into.
3.4 Online Applications must be submitted using the Website or App. Teams will start scoring from the next Scheduled Event Kick-off following the successful submission of the Application. Points will not be backdated.
3.5 Genius Sports and TMG shall not be responsible for Applications lost in transmission or received late due to high online traffic levels. We recommend that registration and transfers are not left until just before the published deadlines.
3.6 All Applications are subject to acceptance by TMG. Genius Sports will confirm such acceptance to you, on behalf of TMG, via email (“Team Confirmation Email”). There will be no contract of any kind between you and TMG unless and until you receive a Team Confirmation Email (in the absence of a Team Confirmation Email, please check your spam folder).
4. Team, League and Manager names
4.1 TMG reserves the right to refuse to accept any team names, Private League names or Manager names which have been duplicated or are felt, in TMG's sole discretion, to be inappropriate, misleading or offensive. Unsuitable names may be deleted or amended so that the team or Private League appears under the Manager's or the Chairman's name. Team names that include website addresses may also be deleted or amended.
5. Player selection
5.1 The players included on the selection list and their values have been determined arbitrarily. Player values remain constant throughout the Competition. TMG shall not enter into any correspondence relating to details of the selection list, nor will it accept the inclusion into a team of any player not on the selection list. New players may be introduced into the Competition by TMG as and when appropriate. These may be listed from time to time within The Daily Telegraph and/or on the Website and/or via the mobile application.
6. Team selection
6.1 Managers' team selections must consist of eleven players chosen from the selection list. The combined total value of their eleven player team selection must not exceed £50 million at any time throughout the Competition. The team of eleven must include one goalkeeper and: four defenders, three midfielders and three forwards (4-3-3) or; four defenders, four midfielders and two forwards (4-4-2) or; three defenders, five midfielders and two forwards (3-5-2) or; four defenders, five midfielders and one forward (4-5-1) or; three defenders, four midfielders and three forwards (3-4-3) or; five defenders, four midfielders and one forward (5-4-1) or; five defenders, three midfielders and two forwards (5-3-2). Managers may switch between formations when making transfers.
6.2 A player can only appear in the same team once at any one time - player duplication is not permitted. There is no additional restriction on the number of players chosen from the same club.
6.3 Managers not wishing to select their own team but wishing to participate in the Competition may do so by clicking the Auto-Complete button during the Application process. An eligible team will be selected for you at random and details of that selection will be shown on-screen.
6.4 Managers of valid team selections that provide a valid email address will be sent a Team Confirmation Email but should be aware that some ISPs and central servers have ‘firewalls’ or other blocking software, which do not allow distribution of game related communications.
7. Scoring points
7.1 Points will be awarded based on all Premier League, FA Cup and League Cup matches (featuring Premier League teams) played from 20.00 (BST) on Friday, August 15, 2025 up to and including the final match, scheduled for Sunday, May 24, 2026.
7.2 Points from abandoned matches will not count towards scoring in the Competition. In the event of an abandoned match, the updated Scheduled Event Kick Off time will be published on the Website. If any kick-off is delayed to a later time in the same day the original Scheduled Event Kick Off time for that match (as stated on the Website) stands. Therefore any transfers made after the Scheduled Event Kick Off in this scenario will not count for that match.
7.3 Points will be awarded and deducted per match as follows:
All players: starting appearance (two points); substitute appearance (one point); goal scored (five points); assist to a goal (three points); red card (minus three points) (note: two yellow cards leading to a red card in the same match counts as one red card); yellow card (minus one point); missed penalty (minus two points); own goal (minus three points).
Goalkeepers only: saves (one point per two saves); penalty save (five points) (for these points to be awarded the goalkeeper must have prevented the penalty from being scored with some part of his body).
Goalkeepers and defenders only: team keeps a full-match clean sheet and player plays sixty minutes or more excluding stoppage time (five points); team keeps a full-match clean sheet and player plays fewer than sixty minutes (two points); first goal conceded (zero points); each additional goal conceded (minus one point). Only points for cards will be attributed during penalty shoot-outs.
Midfielders only: tackles (one point per two tackles).
7.4 Points will not be altered for decisions that are reviewed retrospectively. Therefore the points that are awarded to a player, positive or negative, at the end of a match will remain with that same player. This includes but is not limited to awarding of goals and rescinding of cards.
7.5 The judges' decision shall be final and TMG will not enter into any correspondence regarding points deducted or allocated to players.
7.6 Scores will be updated daily, online at the Website and the mobile application.
8. Live scoring
8.1 As far as possible, during all eligible Premier League, FA Cup and League Cup matches, Managers have the option to view the progress of their TFF team and watch score updates on the Website. Managers will also be able to view periodic Private League updates on match days.
8.2 Important: live score updates are offered purely to enhance Managers' enjoyment of the Competition and points should be regarded as indicative only. All live points are subject to verification. Classified scores will be published following verification by the judging panel appointed by TMG in accordance with Clause 7, “Scoring Points”. Only classified scores will be published outside of the TFF Live page on the Competition website. In the event that live scores vary from classified scores on the Competition website or mobile application, the decision of the judges will be final and TMG is not obliged to enter into any correspondence regarding points allocated to, or deducted from, players.
9. Transfers
9.1 Managers may alter their teams by effecting transfers, which may be actioned online via the Website and App. A total of 45 transfers per team are available during the Competition.
9.2 A maximum of five transfers per team can be made during any one Game Week (Tuesday to Monday). Transfers beyond the maximum number allowed in any Game Week will be rejected as will any transfer requests beyond the seasonal maximum of 45.
9.3 Your five (5) Game Week transfer allocations will reset at midnight on Tuesdays following the completion of a Game Week. Example: your Game Week 2 transfer allocations will become available at 00:00 on Tuesdays.
9.4 Transfer requests shall be acknowledged via on-screen confirmation. TMG shall not be responsible for transfer applications lost in transmission or received late due to high online traffic levels or for incomplete transfer applications.
9.5 A pre-season transfer amnesty shall operate until the first Scheduled Event Kick-off at 20:00 (BST) on Friday, August 15, 2025, which allows Managers to make unlimited changes to their line-up without affecting their season transfer allocation. Following this, transfers may be submitted at any time up until the final Scheduled Event Kick-off, expected to be on Sunday, May 24, 2026.
9.6. Players must be transferred before a Scheduled Event Kick-off time in order to score points in that Event. Players transferred after a Scheduled Event Kick-off time will score points from the next Scheduled Event Kick-off time. If any kick-off is delayed to a later time in the same day the original Scheduled Event Kick Off for that match (as stated on the Website) stands for the purposes of that transfer deadline.
9.7 With all transfers, Managers must ensure that their teams continue to meet the selection criteria.
9.8 Once submitted, transfer requests cannot be altered under any circumstances.
10. Private Leagues
10.1 Entry into TFF shall give Managers the opportunity to form their own Private Leagues and join other Private Leagues.
10.2 Each team may participate in up to five Private Leagues.
10.3 Once a team has joined a Private League it is not possible for that entry to be moved into another Private League. If however the team is removed from a Private League by the Private League's Chairman, that team shall be allowed to join a new Private League provided it adheres to the Private League conditions set out in this Clause 10.
10.4 Private Leagues can be registered via the Website and App. This facility allows applicants to register their team to their preferred Private League. A Chairman must first register the Private League and his/her own team online via Website and App. The Chairman will be instructed to select a League name and will then be allocated a seven-digit League PIN. PIN must be given (in exactly the form they appear) to all invited participants of that Private League or the chairman can choose to send an email invite to other users.
10.6 Leagues can be created and joined at anytime throughout the season
10.7 Private League Chairmen will have the facility to remove members from their Private League until the Private League has begun scoring in its first Game Week.
10.8 Chairmen of Private Leagues are advised to circulate their League PIN only to people they wish to join the League.
11. Public Leagues
11.1 Entry into TFF shall also give Managers the opportunity to join Public Leagues. There are four Public Leagues, the Facebook League, the Twitter League, Fantasy Football Hub League and the Three Lions League.
11.2 Each team is permitted to join one Public League (Twitter, Facebook or Fantasy Football Hub) only but a Manager can join up to four Public Leagues with different teams unless they are an Assistant Manager subscriber which will give users the option to join all their eligible teams
11.3 No further Public League entries will be accepted after the start of the first match of Gameweek 5.
12. Tournaments
12.1 TFF Managers will have the opportunity to participate in free TFF Tournaments. Each Tournament is made up of sixteen teams each managed by a different individual Manager.
12.2 Once sixteen teams join to complete a Tournament, a new Tournament will be made available.
12.3 When a new Tournament is generated, it will begin scoring from the upcoming Game Week.
12.4 Tournaments become available to view once they fill, however points scored from the specified Game Week Start Date for all participating teams will be used, regardless of when the Tournament fills. You can view the specified Game Week Start Date on the ‘About’ page of the Tournament.
12.5 Users subscribed to the Assistant Manager will have the option to create their own tournament league.
12.6 Tournament entries will close at the beginning of the 7th month of the season (January 27th).
13. One League
13.1 TFF Managers will have the opportunity to participate in TFF's One League. There is no limit to the number of Managers that can join the One League, but a Manager can only enter a single team into the One League.
13.2 The winning Manager at the conclusion of the One League will receive a cash prize of £500. In the case of a tie, the standard TFF tie-break rules (Clause 16) will apply.
13.3 No further One League entries will be accepted after the beginning of the first match of Gameweek 5, currently 12:30 on Saturday, September 20, 2025.
14. Super 16s
14.1 TFF Managers will have the opportunity of entering a head-to-head Super 16s League against 15 other Managers.
14.2 Super 16s are open for users to opt-in to join a league or if a user is a Assistant Manager subscriber they will have the opportunity to create their own Super 16 league
14.3 Over the 30 subsequent scoring Game Weeks, teams will compete against each of the other 15 teams in their Super 16s League on a head-to-head basis, playing each other team twice. After each Game Week, three points will be awarded to teams that have scored more points than their opponent and one point if the head-to-head ends in a tie.
14.4 After 30 rounds of head-to-head matches, the Managers whose teams finish top of each Super 16s League will be the winners. In the case of a tie, the standard TFF tie-break rules (Clause 16) will apply.
14.5 No further Super 16 entries will be accepted after the start of Game Week 8.
15. Prizes
15.1 Overall Leaderboard: £5,000 will be awarded at the end of the Competition to the Manager whose team is placed at the top of the Overall Leaderboard. This is the Manager whose team has amassed the highest number of points in the Competition by the end of the final Event scheduled for Sunday, May 24, 2026. The Manager whose team finishes with the second highest number of points in the Overall Leaderboard shall win £250. The Manager whose team finishes with the third highest number of points shall win £100. The Manager whose team finishes with the fourth highest number of points shall win £50. The Manager whose team finishes in last place in the Overall Leaderboard shall win the ‘Wooden Spoon’ prize of £50. An individual Manager can win a maximum of one ‘top three’ prize via the Overall Leaderboard, regardless of the number of valid teams entered.
15.2 Golden Boot Leaderboard: £250 will be awarded at the end of the Competition to the Manager whose team is placed at the top of the Golden Boot Leaderboard. This is the Manager whose team has scored the highest number of goals in the Competition by the end of the final Event on Sunday, May 24, 2026. Goals scored in penalty shoot-outs are not included in a Manager's Golden Boot total.
15.3 The One League: £500 will be awarded at the end of the competition to the Manager whose team is placed at the top of the One League. This is the Manager whose team has amassed the highest number of points in the Competition by the end of the final Event on Sunday, May 24, 2026.
15.4 Starting XI Leaderboard: £200 will be awarded at the end of the Competition to the Manager whose Starting XI team is placed at the top of the Starting XI Leaderboard. This is the Manager whose team amassed the highest number of points in the Competition by the end of the final Event on Sunday, May 24, 2026. The Starting XI is a Manager's original team selection (post transfer amnesty - i.e. your team as of the first Scheduled Event Kick-off at 20.00 BST on Friday, August 15, 2025) and is unaffected by any subsequent transfer activity during the season.
15.5 Monthly Leaderboards: £200 will be awarded at the end of each Game Month to the Manager whose team is placed at the top of the Monthly Leaderboard. This is the Manager whose team has amassed the highest number of points in the Competition within a Game Month. There are ten Game Months in all:
- Month 1: Aug 15 to 1 Sep
- Month 2: Sep 2 to Sep 29
- Month 3: Sep 29 to Oct 27
- Month 4: Oct 28 to Dec 1
- Month 5: Dec 2 to Dec 29
- Month 6: Dec 30 to Jan 26
- Month 7: Jan 27 to Mar 2
- Month 8: Mar 3 to Mar 30
- Month 9: Mar 31 to Apr 27
- Month 10: April 28 to May 25
To be eligible for a prize in a Monthly Leaderboard a Manager must have submitted their teams before the first Scheduled Event Kick-off of the related Game Month.
15.6 Weekly Leaderboards: £50 will be awarded at the end of each Game Week to the Manager whose team is placed at the top of the Weekly Leaderboard. This is the Manager whose team has amassed the highest number of points in the Competition within a Game Week. Game Weeks run every Tuesday to Monday throughout the season, providing there is at least one eligible scoring match played. There are scheduled to be 37 Game Weeks. To be eligible for a prize in a Weekly Leaderboard a Manager must have submitted their teams before the first Scheduled Event Kick-off of the related Game Week. An individual Manager can win a maximum of three Weekly prizes during the Competition.
15.7 Public Leagues: £50 will be awarded at the end of the Competition to the Managers whose teams finish at the top of each of the three Public Leagues - Twitter League, Facebook League, Three Lions League. £100 will be awarded at the end of the Competition to the Manager who finishes at the top of the Fantasy Football Hub League. These are the Managers who have amassed the highest number of points in each of the Public Leagues in the Competition by the end of the final Event on Sunday, May 24, 2026. To be eligible for a prize in the Public Leagues a Manager must have entered their teams into the Public League before the first match of Gameweek 5.
15.11 In the event of a tie for any prize, the standard TFF tie-break rules (Clause 16) will apply – with the exception of Golden Boot prizes where the order of the tie-break is highest number of total points, highest number of Assists, highest number of points scored from Clean Sheets, and lowest number of points deducted for yellow and red cards.
15.12 In relation to all of the prizes listed above, TMG's decision in all matters shall be final. Winners will be notified by email. There are no prize alternatives and the prizes are not transferable. Winners may be required to co-operate with reasonable publicity. Winners' names will be published on the Website and, in some cases, in The Daily Telegraph.
16. Tie-Breaks
16.1 In the event of a tie for any prize, preference will be given to the Manager whose team has scored the most goals during the relevant prize period (i.e. Season, Game Month, Game Week). If the result is still a tie, preference will be given to the Manager whose team has achieved the most points for Assists during the relevant prize period (i.e. Season, Game Month, Game Week), and thereafter the most points from Clean Sheets during the relevant prize period (i.e. Season, Game Month, Game Week). If there is still a tie, preference will be given to the Manager whose team has received the least points for yellow cards and red cards during the relevant prize period (i.e. Season, Game Month, Game Week). If clear positions for the prize winners still do not emerge, the tied Managers will be entered into a prize draw and the first Manager drawn at random will be awarded the prize.
16.2 The exceptions to the standard tie-break rules are with Golden Boot and Wooden Spoon prizes. For the Golden Boot, the order of the tie-break is highest number of total points, highest number of Assists, highest number of points scored from Clean Sheets, and lowest number of points deducted for yellow and red cards. For the Wooden Spoon, the tie break gives preference to the Manager whose team has scored the least goals during the relevant prize period (i.e. Season, Game Month, Game Week). If the result is still a tie, preference will be given to the Manager whose team has achieved the least points for Assists during the relevant prize period (i.e. Season, Game Month, Game Week), and thereafter the least points from Clean Sheets during the relevant prize period (i.e. Season, Game Month, Game Week). If there is still a tie, preference will be given to the Manager whose team has received the most points for yellow cards and red cards during the relevant prize period (i.e. Season, Game Month, Game Week). If clear positions for the prize winners still do not emerge, the tied Managers will be entered into a prize draw and the first Manager drawn at random will be awarded the prize.
16.3 The decision of TMG's judges regarding Tie-Breaks shall be final and binding.
17. General
17.1 TMG reserves the right to refuse to accept any Application, Team entry, Public League entry or Private League entry which in TMG's opinion does not comply with these Terms and Conditions or which contravenes the spirit of the Competition.
17.2 Your data will be collected in accordance with TMG's Privacy and Cookie Policy. If we carry out checks to verify your age (in order to comply with our obligations to the Gambling Commission) we may provide your data to a credit reference agency that may keep a record of your details. Please do not make an Application if you do not wish for this to happen.
17.5 Winners will be notified via email within a reasonable time following a decision by TMG and prizes will be paid within 28 days of such notification. There are no prize alternatives and the prizes are not transferable. Prizes cannot be paid by cheque. If you fail to respond via email or provide correct banking details after 90 days you will forfeit your prize.
17.6 Winners' names, TFF team selections, photographs and any comments made in relation to a prize may be used by TMG without limitation for future promotional, marketing and publicity purposes, in all and any media worldwide without notice and without any fee being paid. Entry and participation in the Competition will be deemed to be your acceptance of these Terms and Conditions.
17.7 The name “Telegraph Fantasy Football”, other trademarks, images and logos relating to the Promoter and the Competition and used in relation to the Competition are the exclusive property of TMG and your participation in the Competition does not confer any rights to you in or over, or grant you any right to use the aforementioned intellectual property of TMG.
17.8 TMG reserves the right at its reasonable discretion to add to or waive these Terms and Conditions on reasonable notice; and/or cancel the Competition or any part of it at any stage in the event of circumstances beyond TMG's reasonable control.
17.9 Genius Sports and TMG shall not be liable for any loss or damage whatsoever which is suffered by any person as a result of, or in connection with, or arising from the Competition, any prize, or these Terms and Conditions, or the use of the same except for any liability which cannot be excluded by law.
17.10 If you have any complaints about the Competition please complete the Contact Us form. We take any complaints you have seriously, and if you contact us we will endeavour to deal with your problem as fairly, quickly and efficiently as possible. If a solution to your problem cannot be resolved by our customer services team we may refer you to our Legal Department.
Assistant Manager Terms & Conditions
1. Overview
- These Terms apply to your subscription for access to and/or utilisation of the Fantasy Goods & Services as provided by us.
- These Terms prevail over any other inconsistent terms in other Genius Sports documents.
- You are taken to have accepted these Terms by subscribing to the Fantasy Goods & Services, making any payment or performing any of these Terms.
2. Game Provider
You agree and acknowledge that the Game is provided by relevant Game Providers and in those circumstances:
- it is the Game Providers (and not us) who are responsible for providing the Game and any associated warranties and guarantees (if any);
- your participation in, access to and use of the Game is governed by the applicable Game Rules as agreed between the Game Provider and you, and you must make your own enquiries as to the suitability of those terms; and
- we are not responsible for any inaccuracies or errors in the information supplied by Game Providers or changes made to the Game.
3. Fantasy Goods & Services
The Fantasy Goods & Services may only be accessed and used by Game Subscribers who have:
- submitted to us the subscription or payment application currently located at the Subscriptions Section; and
- been approved by us.
You acknowledge and agree that:
- we reserve the right to accept your application to use the Fantasy Goods & Services at our sole discretion;
- the Fantasy Goods & Services and the Content may vary from time to time;
You warrant that:
- by subscribing to use and / or purchase the Fantasy Goods & Services you are a Game Subscriber;
- your use of the Fantasy Goods & Services is solely for personal, household or domestic use and not for sub-licensing, resale or any other purpose.
- you will keep your password and account details secure.
You undertake to only access and utilise the Fantasy Goods & Services for the Permitted Use and not for any other purpose or reason and, without limiting the above, you will not:
- make duplicates or copies, electronic, printed or otherwise, of the Content for any other purpose or use;
- provide any of the Fantasy Goods & Services by electronic, printed or other means to any person or otherwise communicate or distribute any of the Content to others;
- distribute, reproduce or display any Content on any electronic network, printed literature, website or otherwise, including without limitation the internet;
- corrupt, update, alter or change any part of the Content; or
- produce or create any derivative works or content based on the Content or the Fantasy Goods & Services.
4. Duration
Unless stated otherwise in these Terms, our responsibilities to provide the Assistant Manager Services commence on the Subscription Date and will expire upon the earlier of:
- The date your subscription is cancelled in accordance with these Terms; or
- When the product ceases to be delivered.
5. Free Trials
We may offer, from time to time, in part or in whole, and at our sole discretion, free trials of the Assistant Manager Services. If you choose to subscribe for a free trial:
- we will make the Assistant Manager Services, in part or in whole, at our sole discretion, accessible and attainable to you during the free trial period (as specified in the Subscription Sections).
- you will be restricted to a maximum of one free trial of the Assistant Manager Services unless otherwise specified by us.
- You acknowledge that we are under no obligation make access to any or all components of the Assistant Manager Services available during any such free trial and for the avoidance of any doubt, certain features will not be available in the Free Trial, as communicated via the Website from time to time
6. Purchases, Subscription Charges and Payment
Assistant Manager Services
- you may subscribe for the Assistant Manager Services on a monthly or season long basis (or other term as may be otherwise provided by us from time to time) in accordance with these Terms.
- The subscription charges payable by you for access to and viewing of the Assistant Manager Services are detailed in the Subscription Sections;
- Subscription charges will be made to your chosen payment method.
Monthly Subscriptions
- Your first monthly subscription charge will be charged on the Subscription Date and then on the same date of each subsequent month until cancelled by you.
- You recognise and accept that you will not be entitled to any pro rata or other type of refund of the subscription charges if the period between the date of the last payment of a monthly subscription for a Game Term and the time you cancel your subscription is less than one month.
Season Subscriptions
- Season subscription charges will be charged on the Subscription Date.
- Season and/or monthly subscriptions are only available during the Game Term, as specified in the Subscription Sections.
Purchases
- Purchases will be on a one off basis and will not incur any repeat payments.
- Delivery of purchases will be made within one month of the completion of the relevant League.
7. Suspension
If any subscription charges are not paid by the due date (including being rejected by your credit card issuer or other payment provider) we may, at our sole discretion, suspend your ability to access and use the Assistant Manager Services until the relevant subscription charges are paid in full.
8. Cancellation By and Refunds to You
Assistant Manager Services
- You may cancel your subscription if you are a subscriber by sending a cancellation request to our support desk: https://fantasyfootball.telegraph.co.uk/help/contact-us.
- The cancellation of your subscription will be effective on and from the date the next payment of subscription fees would have been charged to your chosen payment method, but for the cancellation (Effective Cancellation Date) after the receipt of your cancellation form. During the period between the date you submit the cancellation form to us and the Effective Cancellation Date, we will continue to provide access to the Assistant Manager Services to you and you will not be entitled to any refund of subscription charges for this period, pro rata or otherwise.
- If you are a season subscriber, to receive a refund you may only cancel your season subscription during the 7 days following the Subscription Date. You may cancel your subscription by submitting a cancellation request to our support desk: https://fantasyfootball.telegraph.co.uk/help/contact-us. If you decide to cancel your season subscription during this 7 day cancellation period, we may immediately cancel your access to the Assistant Manager Services. Within 30 business days of receiving your notice of cancellation we will refund to you the pro rata balance of the season subscription charges paid by you.
- You acknowledge that if you cancel a season subscription once the 7 day cancellation period specified above has expired, then you will not receive a refund for that season
9. Cancellation By Us
In the following circumstances we may immediately stop your access to the Fantasy Goods & Services and any subscription charges will not be refunded:
- Your rights to be a registered user are terminated in the Game due to a breach of the Game Rules or other applicable terms and conditions by you;
- You violate any material provision of these Terms;
In the following circumstances your access to the Fantasy Goods & Services will cease and we will refund to you all subscription charges and payments on a prorated basis
- The Game is cancelled or otherwise ceases to operate for reasons beyond our control; or
- The Game is cancelled or otherwise ceases to operate at our sole discretion.
10. Payment Method Details
Any mode of payment including credit card, debit card, online payment method or other similar details you provide to us for the purpose of subscribing to the Game will be stored and used by us for the purpose of processing your payments of the subscription charges. You acknowledge that we may provide your credit card, debit card, online payment method and other similar details to any other party we appoint to process credit card or electronic payments for us. We will use our best endeavours to ensure your details are kept secure.
11. Intellectual Property
The Content contains intellectual property including trade marks, confidential information and copyright, together with any goodwill or reputation and Intellectual Property Rights subsisting in those things.
You acknowledge and agree that:
- we own all Content or it is licenced to us by third parties and unless permitted by law, you must not copy, reproduce, transmit, display or otherwise distribute it in whole or in part without our prior written consent.
- your use of ,and access to the Content does not assign any rights in those things
- upon creation, all rights (including any Intellectual Property Rights) in any developments or improvements to the Content automatically vest in us and you hereby assign any rights in those improvements to us.
12. Guarantees and Warranties
- We acknowledge that the supply of the Fantasy Goods & Services are “consumer” supplies, in the United Kingdom, under The Consumer Rights Act 2015.
- You acknowledge that nothing in these Terms purport to modify or exclude the Non-Excluded Guarantees.
- In addition to the Non-Excluded Guarantees, we hereby agree that the Fantasy Goods & Services will be provided:
- in compliance with any applicable laws;
- to the same standard to which a prudent and experienced provider would normally provide the Fantasy Goods & Services ;
- diligently, competently, with care and skill and in a proper and professional manner; and
- Except and only to the extent that these guarantees or warranties are inconsistent with Non-Excluded Guarantees, we do not and cannot provide any guarantees or warranties that:
- the information associated with the provision of the Fantasy Goods & Services will be entirely accurate or correct, dependable or appropriate for any particular purpose; or your use of the Fantasy Goods & Services will ensure any scores, performance, results or other similar events based on the Game's predictions or estimations or that any such predictions or estimations will be accurate or correct; and the Fantasy Goods & Services will be free of outages, interruptions or other similar issues; or the Fantasy Goods & Services and Content will be compatible with any computer software, computer hardware, internet browser, mobile device or other devices, or any other technology;
You warrant and represent to us that any and all:
- information submitted by you to us in your application for subscription or as otherwise provided is complete, true and accurate at the time of submission; and
- credit card, debit card or other payment method details you provide to us are correlated to a card issued to you or payment method that you are authorised to use for the subscription fees.
13. Liability
- Subject to this clause and so far as may be permitted by law, the liability of related parties, employees and/or agents for a failure (other than a major failure) to comply with a Non-Excluded Guarantee, shall be limited to, at Genius Sports' option:
- Refund of any fees paid; or
- Subject to the Game still being available, free access to the Fantasy Goods & Services during the same calendar year, for a period of time equal to the loss suffered during that calendar year,
- Subject to this clause 13 and so far as may be permitted by law, if a failure of Genius Sports to comply with the Non-Excluded Guarantees cannot be remedied or is a major failure, your right to recover damages is limited to the reasonably foreseeable loss or damage suffered as a result of that failure. However, Genius Sports is not liable for loss or damage that results from a failure of Genius Sports or the Game Provider to comply with the Non-Excluded Guarantees if that failure was caused independent of human control.
- In circumstances where the Non-Excluded Guarantees do not apply, Genius Sports, its employees and/or agents shall not be liable for any loss or damage (including any consequential loss or damage, which includes, without limitation, loss of profits and loss of revenue) of any kind whatsoever, even if due to the negligence of Genius Sports, its employees and/or agents or the Provider.
- Subject to this clause 13, you acknowledge that:
- the Assistant Manager Services are statistics, data, information and analysis services which attempt to predict future events and performances of athletes and by their very nature are unpredictable; and given the unpredictable nature of the Game and multiple variables involved in the Game, you cannot depend on the effectiveness, relevance, completeness or accuracy of the Assistant Manager Services or Content and you should perform your own enquiries and undertake your own independent research and analysis before playing the Game or making decisions in regards to the Game.
14. Privacy
Periodically we collect certain required personal information, as defined in The Data Protection Act 2018 (which is the UK's implementation of the General Data Protection Regulation (GDPR) from you, which you provide to us when applying for, subscribing for and/or accessing the Fantasy Goods & Services. We may use such personal information to allow us to provide the Fantasy Goods & Services to you, to communicate changes to the services with you and to provide information to you about other products or services you might be interested in, unless you inform us in writing that you do not want this information. In managing your personal information, we will comply with the The Data Protection Act 2018. We will only disclose personal information about you to a third party when required by law. Given Subscriptions are only available to Game Subscribers, our compliance with privacy legislation is set out in the separate Privacy Policy which may be accessed from the following link: https://geniussports.com/policies/privacy-policy that governs the Game. You (and your parent or legal guardian if you are under 18 years of age) acknowledge, understand and agree that the Game Provider may use and disclose the information provided by you to Genius Sports, and to the Game Provider by Genius Sports on the terms and for the purposes (including marketing) set out in the Game Provider's Privacy Statement available at https://geniussports.com/policies/privacy-policy or by calling 08000478944, as if you were a customer of the Game Provider. You (and your parent or legal guardian if you are under 18 years of age) agree that the Game Provider can continue to contact you even after the Game ends. If you would like to access or correct the personal information that the Game Provider holds about you, or if the Game Subscriber does not wish the information to be disclosed, you should advise the Game Provider by phoning 1800 039 059.
15. VAT
All prices are quoted inclusive of VAT. The VAT imposed on any supply made by the us to you pursuant to these Terms (the VAT Amount), must be paid by you, in addition to any amount payable, and any non-cash consideration provided, for that supply (without any deduction or set-off) by you under any other clause in these Terms). Any VAT Amount payable is payable upon demand by us whether such demand is by means of any invoice or otherwise. If any part of the purchase price is referable to both a taxable supply (as defined in the VAT law) and anything that is not a taxable supply, the apportionment of the purchase price between those supplies shall be determined by us, and VAT applied accordingly.
16. Force Majeure
We will not be liable for any failure to perform or delay in performing any obligation under these Terms insofar as the failure or delay is caused by an event beyond our reasonable control, including but not limited to riot, labour dispute, terrorism, revolution, criminal act, acts of restraint of government or regulatory authorities, flood, earthquake, fire or any other type of natural disaster, failure of computer equipment, ongoing telecommunications or internet outage or failure or delay of statistical feeds or sources of content from which data required to produce the Fantasy Goods & Services are derived.
17. General Provisions
The above Terms form the entire and complete agreement between us and you in regards to the Fantasy Goods & Services and override all previous agreements and understandings. No variation to these Terms will be applicable unless agreed in writing by you and us. If any clause within these Terms is held to be unenforceable or invalid by any court of applicable jurisdiction, all and any remaining provisions will remain intact and unaffected and continue to be carried out according to the original purpose and intent. These Terms are governed by the laws of the United Kingdom, and each party agrees that any dispute arising out of these Terms will be dealt with in the courts of the United Kingdom.
